How to transform a business premises into a home?

To transform your professional or commercial premises (office, shop, medical practice...) into housing, you have to make approaches to the city planning services and taxes. If your premises are co-owned and/or rented, you also have to contact the trustee and/or the owner respectively. We're presenting the regulations.
In any case, you must verify that your project is compatible with the rules of the MORE: titleContent of your commune. To find out about these rules, you must contact the city planning department of your city hall.
By transforming a business or commercial premises into housing, you change its destination. Depending on whether or not your change of destination is accompanied by a facade change, you must file a Advance Work Statement (AD) or a request for building permit (PC) to the town hall.

Change of destination only
One change of destination without modification of the facade or the supporting structure is subject to DP.
Depending on whether your project is located in Paris or in another municipality, the application must be submitted:
- By dematerialized according to the provisions adopted by the municipality (see the site of the town hall or on the spot)
- By letter RAR: titleContent
- In person against receipt signed by the city hall.
General case
You must complete and submit your RFP file by paperless means according to the arrangements made by your municipality or on a paper form. Inquire on the website of the city hall or on site.

Prior declaration of construction and works not subject to a building permit
In Paris

One change of destination accompanied by a modification of the facade and/or the supporting structure is submitted to PC.

When converting a business or commercial premises into a home, you must pay a development tax. This can also affect your property taxes. However, you no longer have to pay the territorial economic contribution (TEC).

You must declare the assignment change by filling out a form:
Change in the consistency or use of built and non-built properties (Declaration No 6704)
You must send it by mail RAR: titleContent or deposit it at the land registry office on which your premises depends, within 90 days of the change of destination.
Who shall I contact
The co-ownership rules sets the destination of the building (home, office, business...).
If the transformation of your premises does not respect this destination, you must request the authorization of change assignment from your premises to general meeting of co-owners.
The decision shall be taken byunanimity of all co-owners.
As a tenant, you must obtain written permission from the landlord to convert your business or commercial premises into a home. Your landlord is free to accept or decline.
As the owner, you must respect the decency characteristics if you intend to rent the future accommodation.
Please note
Your lease can no longer be professional or salesman. Depending on the case, you must sign a principal residence tenancy contract, one contract for the rental of furnished tourist accommodation or even a mobility lease.
